Judge Who Tried to Ground Migrant Gang Flights Hit With Impeachment

A Republican lawmaker from the House has put forth articles of impeachment against the federal judge who halted the Trump administration’s deportation flights under the Alien Enemies Act, as reported exclusively by Fox News on Monday.

“For several weeks, we have witnessed a number of activist judges attempting to obstruct the president from fulfilling not only the mandate given to him by voters but also his constitutional and democratic authority to ensure the safety of the American populace,” stated Rep. Brandon Gill, R-Texas, in an interview with Fox News Digital. “This instance exemplifies yet another case of a judge overstepping his authority.”

Gill’s resolution charges U.S. District Court Judge James Boasberg with misusing his power by imposing an emergency injunction against the Trump administration’s attempts to deport illegal immigrants under a wartime statute established in 1798. Recently, President Donald Trump invoked this law to expel members of the Venezuelan criminal organization Tren de Aragua from the United States. “Chief Judge Boasberg ordered President Trump to redirect planes midair that were carrying individuals linked to Tren De Aragua, a recognized Foreign Terrorist Organization,” the resolution stated. “Such actions endanger national security, constitute an abuse of judicial power, and disrupt the proper functioning of the judiciary. By exercising his authority, Chief Judge Boasberg has sought to usurp power from the Executive Branch and interfere with the will of the American people.”

In a brief conversation with Fox News Digital just prior to submitting his resolution, Gill expressed his preference for the issue to be addressed through the House’s conventional process, beginning with a review by the House Judiciary Committee, of which he is a member. “I will be discussing this with [Chairman Jim Jordan, R-Ohio],” Gill remarked. “I believe the most effective approach is to navigate through the judiciary committee, as that is the proper channel for judicial impeachments. The more we adhere to that plan, the more advantageous it will be.”A legal dispute is escalating following Judge Boasberg’s verbal issuance of a 14-day restraining order on Saturday night, which halts the Trump administration’s initiative to deport members of Tren de Aragua. This decision was made in response to concerns raised by human rights organizations, which argue that Venezuelan nationals with valid asylum claims could face wrongful deportation despite lacking any connections to the infamous gang.

The Texas Republican, who holds the position of class president for first-term members in the 119th Congress, initially threatened to pursue articles of impeachment against Boasberg on Sunday. Trump supported this initiative on Tuesday morning through a passionate post on his Truth Social account.

In his post, Trump labeled Boasberg a “Radical Left Lunatic of a Judge, a troublemaker and agitator,” asserting, “HE DIDN’T WIN ANYTHING! I WON FOR MANY REASONS, IN AN OVERWHELMING MANDATE, BUT FIGHTING ILLEGAL IMMIGRATION MAY HAVE BEEN THE NUMBER ONE REASON FOR THIS HISTORIC VICTORY.” He further stated, “I’m just doing what the VOTERS wanted me to do. This judge, like many of the Crooked Judges I am forced to appear before, should be IMPEACHED!!!”

Gill contended that Boasberg was deliberately “tying the president’s hands so that Trump and his team, instead of executing on the mandate the voters gave him, are litigating every single action that the president is taking.” He characterized this as “unconstitutional” and a “usurpation of executive authority.”

The Trump administration has noted that the judge’s written order was issued after two planes carrying alleged gang members had already taken off, arguing that it was too late to redirect the flights at that stage. They also mentioned that a third plane, which departed after the first two, did not carry any deportees under the Alien Enemies Act.

“All of the planes that were subject to the written order, the judge’s written order, took off before the order was entered in the courtroom on Saturday,” stated White House press secretary Karoline Leavitt on Monday, emphasizing that the White House did not violate any order.Later in the day, during a hearing in his courtroom, the judge expressed skepticism, as reported by The Associated Press. He addressed the U.S. attorney for the administration, stating, “I am simply inquiring how you believe my equitable powers do not apply to a plane that has left the U.S., even if it is currently in international airspace.”
